These Terms of Service (“Terms”) govern your access to and use of amplifyOMS, LLC’s platform, software, and related services (“Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, you may not use the platform.
To use amplifyOMS, you must:
Be at least 18 years old
Have authority to bind your clinic, business, or organization to these Terms
Use the platform only for lawful business purposes related to audiology or hearing care
You may not use the platform for any illegal, unauthorized, or abusive activity, including spam, harassment, or exploitation of system vulnerabilities.
Access to amplifyOMS is granted via subscription and subject to timely payment of fees. We reserve the right to suspend or terminate access for:
Failure to pay
Breach of these Terms
Unauthorized access or misuse of the platform
Platform uptime is a priority, but we do not guarantee 100% availability. Scheduled maintenance and unavoidable outages may occur.
You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at [email protected] if you suspect any unauthorized access or account breach.
You agree not to share account credentials with unauthorized users.
You retain ownership of all data input or collected through your use of amplifyOMS.
By using our platform, you agree to:
Comply with all applicable laws and regulations, including HIPAA, CAN-SPAM, and TCPA/A2P 10DLC
Obtain proper consent before sending SMS, emails, or marketing communications via our system
Only store, transmit, or process data for lawful purposes
We reserve the right to disable features or limit access if unlawful or abusive use is detected.
Our platform supports SMS and email communication. You are solely responsible for ensuring your use of these features is compliant with:
A2P 10DLC regulations
Telephone Consumer Protection Act (TCPA)
All local, state, and federal privacy laws
You must obtain express written consent from contacts before sending automated messages. Failure to comply may result in immediate termination of your messaging privileges and/or your account.
Subscription fees are billed in advance and are non-refundable unless otherwise specified in writing.
Late payments may result in account suspension
Additional services or add-ons (e.g., extra users, integrations) may incur separate charges
Any updates to pricing will be communicated in advance
Support is available during regular business hours via support ticket
We aim to respond to standard support requests within 1 business day. Critical issues are prioritized.
All software, platform features, designs, and content (excluding your own content) remain the intellectual property of amplifyOMS, LLC.
You are granted a limited, non-exclusive, non-transferable license to use the platform during your subscription term.
You may not copy, resell, reverse-engineer, or attempt to extract source code without our written permission.
You may cancel your subscription at any time with 30 days' written notice.
We reserve the right to suspend or terminate your account if:
You breach these Terms
You engage in fraudulent or abusive behavior
You violate platform usage policies
Upon termination, access to the platform will be revoked, but you may request a data export of your content.
To the fullest extent permitted by law:
amplifyOMS is not liable for indirect, incidental, or consequential damages
We are not responsible for loss of revenue, data, or business interruption
Our total liability is limited to the amount paid by you in the 3 months preceding the claim
We may update these Terms periodically. Continued use of the platform after updates are posted constitutes your acceptance. We'll notify you of material changes.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
